The Kwanlin Dun First Nation is seeking the court order one of its citizens to remove property from land in the Marwell Industrial area.
The First Nation wants to develop Lot 226, but claims that Tim Smith is keeping old personal property there.
Court documents suggest that Smith is using the land to store vehicles and other possessions.
Kwanlin Dun says it has been advising Smith since 2013 to remove his property.
The First Nation wants the court to issue an order to allow it to remove Smith's property, if he does not do so.
Smith has not responded to the suit.
Kwanlin Dun has developed a draft conceptional plan for the land, which includes commercial activity.
